Presumptive taxation under section 44ADA

Section 44ADA is the most important provision in Indian freelance tax. Eligible professionals — including engineering, technical consultancy, legal, medical, accountancy and interior decoration work — can declare 50% of gross receipts as profit and pay tax on that half only. No books of account, no audit, no expense substantiation.

The effect on your effective tax rate is dramatic. A freelancer with ₹30 lakh of receipts declares ₹15 lakh of income, and the tax on that is a small fraction of what a 30% marginal rate on gross receipts would suggest. The rate calculator on this site models this by default, which is why the tax figure it shows is lower than most freelancers expect.

The trade-off is that you cannot then claim actual expenses separately — the 50% deduction is deemed to cover them. If your genuine expenses exceed half your receipts, regular taxation with proper books will serve you better.

Advance tax: four dates that matter

If your total tax liability for the year exceeds ₹10,000, you must pay advance tax in instalments rather than a single payment at filing. Freelancers with lumpy income routinely miss this and pay interest for the privilege.

TDS under section 194J is not a cost

Indian business clients deduct 10% TDS on professional fees under section 194J before paying you. This money is not lost; it is deposited against your PAN and appears in Form 26AS and your Annual Information Statement, where it offsets your final liability and is refunded if you overpaid.

Two practical rules. Check 26AS quarterly — deductions that were withheld but never deposited are the single most common cause of refund problems. And build the timing into your cash-flow planning, since a 10% haircut on every domestic invoice means a refund cycle rather than a loss.

New regime or old regime?

The New Tax Regime is the default and offers wider slabs with a rebate that makes income up to ₹12 lakh effectively tax-free for resident individuals, but it removes most deductions and exemptions. The old regime keeps 80C, 80D, HRA and the rest at the cost of narrower slabs.

For a freelancer already halving taxable income via 44ADA, the additional deductions in the old regime rarely outweigh the wider new-regime slabs. Model both once a year rather than assuming; the calculator on this site lets you switch between them and see the effect on your required rate.

Filing and records

Freelancers using presumptive taxation generally file ITR-4 (Sugam); those maintaining regular books file ITR-3. Even under 44ADA, keep invoices, bank statements, foreign remittance certificates and client contracts. They cost nothing to store and are the only defence if a return is picked up for scrutiny.

    Treat 50% of gross professional receipts as taxable income. The remaining half is deemed to cover all business expenses, so you do not itemise them separately.

    Compare the slab outcome under both regimes for your presumptive income, including the 4% health and education cess. The New regime usually wins when you have few deductions to claim.

    Schedule advance tax instalments
